TRADEMARKS

We provide an array of services to clients concerning selection, clearance, registration (both United States and international) and enforcement of trademarks and service marks. We assist clients in analyzing potential new marks, prosecuting registration applications with the United States Patent and Trademark Office and overseeing the prosecution of registrations in foreign countries. Our services include trademark portfolio maintenance, domain name counseling, negotiation of trademark licenses and litigation of infringement and unfair competition actions.

COPYRIGHT

We offer comprehensive copyright counseling. In addition to assisting with copyright registrations, we provide counseling on copyright ownership and licensing issues, and litigation of copyright infringement actions.

Our copyright practice encompasses computer software programs, internet rights and other technology-related matters, as well as books, photographs, movies, illustrations and other published works and works of art.

ENTERTAINMENT

We represent numerous clients in the entertainment industry, including many who provide services to the entertainment industry.

Among clients are best-selling authors, nationally syndicated cartoonists, professional photographers, and fine artists. We represent art galleries, publishing companies, computer game developers and multimedia companies. We also provide securities law counseling for limited partnership offerings and other investment vehicles intended to raise financing for film projects, theater work and other entertainment ventures.

We have extensive experience advising owners of entertainment properties concerning the licensing and merchandising of those properties, including television, film and book deals, publishing agreements, and educational programs and product licenses.

LICENSING AND TECHNOLOGY TRANSFER

We advise clients on licensing and related transactions in every field, including trademark, copyright, patent, and technology. We represent both licensors and licensees and participate at every stage of the transaction, from initial development of products or technology through license agreements intended for end-users.  Our experience includes transactions involving multiparty joint ventures and technology transfers, distribution and marketing agreements, and related documents, such as development and maintenance agreements and other contracts.

TRADE SECRETS

We provide comprehensive advice regarding the development, exploitation and maintenance of trade secrets. We assist clients in developing trade secret protection programs through customized contracts, and specialized procedures and controls to enhance the value of trade secrets.  We also counsel clients regarding the use of trade secrets, such as third-party licensing arrangements, as well as means of restricting use of trade secrets by ex-employees or others who have had access to those materials. For clients involved in trade secret disputes, we provide counseling and litigation services.
